General Terms and Conditions (GTC) for SonicSmile

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed via the SonicSmile online shop (SonicSmile GmbH, St. Karli-Str. 13c, 6004 Luzern, Switzerland).

3. Offer and Contract Conclusion

The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to order. By clicking the "Buy Now" button, you place a binding order for the items in your cart. The confirmation of receipt of your order occurs immediately after the order is submitted and does not yet constitute acceptance of the contract. We may accept your order by sending an order confirmation via email or by delivering the goods within five days.

4. Prices and Shipping Costs

The prices listed on the product pages include the statutory VAT and other price components.

Germany: Free shipping for orders over 35 EUR, otherwise 3.99 EUR.

5. Payment Terms

Payment can be made via:

• PayPal
• Credit Card (Visa, Mastercard, American Express)
• Apple Pay

All payments are processed through the payment service provider Stripe. Payment is due immediately upon completion of the order.

6. Delivery

We deliver within Germany and the EU to the address you provide.

• Standard delivery time in Germany: 1-2 business days.
• Standard delivery time in the EU and other: 3-7 business days.

We do not deliver to countries outside the EU. (Except for England and Switzerland)

7. Retention of Ownership

The goods remain our property until full payment has been made.

8. Warranty

If the delivered goods are defective, you are entitled to a replacement. Further claims are excluded unless mandatory liability applies. In particular, we are not liable for damages not caused to the delivery item itself, nor for lost profits or other financial losses of the customer.

9. Liability

We are liable without limitation for intent and gross negligence. For simple negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), the fulfillment of which enables the proper execution of the contract and on whose compliance the contractual partner may regularly rely. In this case, liability is limited to foreseeable, contract-typical damage.

10. Right of Withdrawal

Consumers are entitled to a right of withdrawal in accordance with our Return Policy and Right of Withdrawal.

11. Data Protection

The protection of your personal data is important to us. All information on data protection can be found in our Privacy Policy.

12. Contract Language

The contract language is German.

13. Final Provisions

If individual provisions of these General Terms and Conditions are invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the relevant statutory provisions shall apply.

Swiss substantive law shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
