1. Scope of Application
These General Terms and Conditions apply to all orders placed by consumers and businesses through the online store sonicsmile.shop.

3. Offer and Conclusion of Contract
The presentation of products in our online store does not constitute a legally binding offer but rather an invitation to place an order.
By clicking the order button, you submit a legally binding offer to purchase the goods contained in your shopping cart.
Receipt of your order will be confirmed immediately after submission. This confirmation does not yet constitute acceptance of your contractual offer.
We accept your order by sending an order confirmation by email within five days or by delivering the goods.
4. Prices and Shipping Costs
All prices displayed are final prices and include the applicable statutory VAT.
Additional shipping costs may apply according to our shipping terms. The shipping costs applicable to your order will be displayed before you submit your order.
5. Payment Terms

Credit card and Apple Pay payments are processed through our payment service provider Stripe. PayPal payments are processed through PayPal.
The purchase price is due immediately upon completion of the order.
6. Delivery
We deliver to the countries listed in our shipping terms.

7. Retention of Title
The goods remain our property until full payment has been received.
8. Liability for Defects
The statutory liability for defects applies.
If the delivered goods are defective, you are initially entitled to request subsequent performance, meaning either repair of the defect or delivery of a defect-free replacement product at your choice.
If subsequent performance fails, is refused by us, or is not completed within a reasonable period, you may withdraw from the contract, request a reduction of the purchase price, or claim damages.
The limitation period for claims based on defects is two years from receipt of the goods.
9. Liability
We shall be liable without limitation for intent, gross negligence, and damages resulting from injury to life, body, or health.
For ordinary negligence, we shall only be liable in the event of a breach of essential contractual obligations, meaning obligations whose fulfillment is necessary for the proper performance of the contract and on whose compliance you may regularly rely.
In such cases, liability shall be limited to foreseeable and typical damages arising from the contract.
Liability under the German Product Liability Act remains unaffected.
10. Right of Withdrawal
Consumers have a statutory right of withdrawal.

12. Contract Text and Correction of Input Errors
We store the contract text and send your order details to you by email.
Before submitting your binding order, you can review and correct your entries in the order overview at any time using the usual keyboard and mouse functions as well as your browser's back function.
13. Contract Language
The contract language is German.
14. Final Provisions
If individual provisions of these General Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by the applicable statutory provisions.
The substantive law of the Swiss Confederation applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you have your habitual residence in the European Union, mandatory consumer protection provisions of your country of residence remain unaffected by this choice of law.
